At the
end of September we sent out a FranFlash informing
you about the new disclosure law in Belgium which
was expected to become law on 18 October 2005 with
retrospective effect from 1 September 2005.
However, on 17 October the Belgian Senate invoked
its "Evocatierecht", which is its right to review
the text of proposed laws and suggest
modifications to the text, if at least 15 Senators
ask to do so. The 15 Senators who invoked the
Evocatierecht on the disclosure laws are mostly
from the CD&V Catholic Party, which does not
take part in the national government.
The
Senate Commission on Finances and Economics is now
obliged to review the proposed new laws. At the
moment, it is not known whether there will be any
suggested changes as the proposed disclosure laws
have not yet been reviewed and discussed by the
Commission on Finances and Economics, nor is it
known when the review process will be
undertaken.
The new disclosure laws are
therefore currently in a state of flux.
We
are monitoring the situation very closely and we
will provide a further update when the Belgian
Commission on Finances and Economics has completed
its review.
If you would like any further
information now please contact Mark Abell or Babette
